Il diritto di habeas corpus è tra tutti da sempre il mio preferito.
E' antico come le enclosures, cioè a dire l'atto con il quale i baroni del re, lassù in Inghilterra, passato l'anno 1200 d.C. presero a recintare i pascoli che fino ad allora erano stati liberi e ne rivendicarono la proprietà.
Dovevano essere un bel po' inariati, i baroni, perchè nel 1215 costrinsero il re, John the Lackland, che altri non era che il nostro Giovanni Senza Terra, quello di Robin Hood, a emanare - con tutta probabilità senza minimamente averne idea - il documento fondamentale e più civile del diritto moderno, la Magna Charta.
Dentro la Magna Charta sta la prima definizione espressa - e perfetta - dell'habeas corpus.
Sia portato davanti a un giudice colui che si vuole condannare.
E' il principio di legalità, che irrompe nella storia, e che storia - e la cambia per sempre.
